If you
are planning on building a pond you may be required to obtain one or
more permits before beginning your project. Permits are required for
construction in areas considered to be wetlands, for construction and
operation of dams over a certain size, or if your pond or lake is considered
a significant risk to people or property downstream. Make sure you
discuss your project with the appropriate agency and obtain all of the
necessary permits before beginning your project.
If you think your selected pond site may be in a wetland area, contact
the NRCS. They will be able to tell you if your proposed
site is a wetland, and they will help you to obtain the appropriate paperwork.

For permit information on dam construction, operation, or transfer, you
should visit the Arkansas Natural Resources Commission. You
will find information and permit applications at ANRC homepage.
Also, as you are planning your pond, keep in mind that you may be eligible
for one of several tax incentives. One such tax incentive is available
under the Water Resource Conservation and Development
Incentives Act (link). Another
incentive possibility is created under the Arkansas Private Wetland and Riparian
Zone Creation and Restoration Incentives Act. To see if your project
qualifies, read the information provided here.
